These Terms of Service (“Terms”) govern your access to and use of the website and services provided by Delache Designs (“Delache Designs”, “we”, “us”, or “our”), a web development and design studio based in Brisbane, Queensland, Australia. By using our website or engaging our services, you agree to these Terms.

Our services

We provide web design, web development, and related services on a flat monthly plan. Plans are month-to-month with no fixed-term contract. The specific scope, deliverables, and turnaround for your work are as described on our website or otherwise agreed with you in writing.

Payments and billing

• Subscriptions are billed monthly in advance via our payment provider, Stripe.
• Plans are month-to-month and you may cancel at any time; cancellation takes effect at the end of the current billing period.
• Unless stated otherwise, fees are non-refundable for the current billing period.

Revisions and scope

Revisions are provided as described for your plan. We will work with you in good faith to deliver results you are happy with. Requests materially outside the agreed scope may require a separate arrangement.

Intellectual property and website buyout

Ownership of deliverables is as agreed for your plan. Website buyout options are available; the terms depend on the scope of work delivered and will be confirmed with you directly. Until any agreed buyout or transfer is completed, work produced remains subject to these Terms.

Your responsibilities

You agree to provide the content, access, and feedback reasonably needed for us to deliver the services, and to ensure that any materials you supply do not infringe the rights of others.

Disclaimers

We provide our services with reasonable care and skill. Except as required by law (including the Australian Consumer Law), our services are provided “as is” without further warranties. Nothing in these Terms excludes any consumer guarantee that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, our liability arising out of or in connection with the services is limited to the amount you paid us in the three months preceding the relevant claim.

Termination

Either party may end the engagement in line with the cancellation terms above. We may suspend or terminate access where these Terms are breached.

Governing law

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.

Changes to these Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated “Last updated” date.
